NOTICE OF IMMINENT NEW LAW SUITS

Re: DV-12-234; DM-12-610; CV-12-1307; CV-12-10816; & regarding criminal actions

Dear Attorney Alain Jackson & Barrie Crowe aka Barrie Derringer aka Barrie Beverley:

Both of you had ignored the previous demand letter sent in March, 2014 regarding (you’) stealing, illegally detaining and concealing my personal property in larceny and embezzlement.
Brief History
Both Barrie Crowe aka Barrie Derringer aka Barrie Beverley and Alain Jackson have done serious damage to David Derringer in a conspiracy since Barrie left and abandoned her husband David and their marriage without cause on December 27, 2011. This included perjury, fraud, misrepresentation to the courts, deceit, unwarranted abuse of both David and the Derringer animals, and many more illegal and immoral actions; all of which were unlawful, and without valid reasons, without conscience, unwarranted, and were meant to hurt, destroy, and damage David Derringer as much as possible, including taking Constitutional and statutory rights, depriving income and profession, and hurting the Derringer animals by these malicious and deliberate actions. This also entailed the illegal breaking and entering the Derringer storage at 101 Florida SE Unit C, with Barrie involved, or certainly not stopping criminal assault and battery against her own husband and larceny of personal and community property at the time of February 4, 2012 with pre-orchestrated actions by Barrie’s bosses of Debbie and Irwin Harms and ten other persons against only David Derringer (12 to 1) wherein both verbal and physical assault and battery took place without Barrie stopping any actions against her own husband. Three consecutive illegal break ins occurred (stealing and damaging over $55,000.00 of David Derringer’s personal property) on February 4, 2012, February 25, 2012, March 8, 2012, (all illegal without any service of summons of the unlawful and fraudulent “order of protection” DV-12-234 Barrie filed in vicious and unwarranted persecution against her husband on February 6, 2012); and attack at the Rio Puerco area which David Derringer was staying with the Derringer animals on July 3, 2012 at the very time and date that David Derringer appeared in court with Barrie Derringer from 2:00PM to 5:00PM, (only Barrie knew of David Derringer’s whereabouts) indicating that Barrie’s cocaine and biker “friends” were likely involved in the ensuing burglary and larceny of over $4,000.00 of David Derringer’s personal property and severe intimidation and physical harm to the Derringer dogs. It seems likely, due to all of the unconscionable acts without any remorse by Barrie since December 27, 2011, that she has indeed done such abuse and viciousness against others in her past prior to David Derringer, probably in both “friendships” and “marriages”, and accomplice Alain Jackson has also been involved in the same types of activities in both his personal and professional lives with both relationships and clients, although he was acquitted of “domestic violence against a household member” recently in court DV criminal action. In the past Barrie must have escaped “accountability” and simply “moved-on” as she favors such expression, after the wrath and damages she inflicts without any guilt; such actions apparently applauded by her own family without conscience. Similarly, Alain Jackson hides and escapes “accountability” by misrepresentation and fraud to the courts.
In this matter, tens of thousands of dollars of sole and separate David Derringer “personal property” has been stolen by Barrie and co-conspirator Alain Jackson, and whereas Barrie stole additionally all money from the Derringer bank accounts, stole the 2005 Chevy Silverado 4X4 dually, stole all of the community property, stole thousands of dollars in David Derringer’s sole and separate inheritance monies-some paid to rescue Barrie from past pre-marriage IRS violations, and Barrie stole community income while married, and has done as much damage mentally, physically and emotionally to David Derringer as they could collectively, with other accomplices of bosses and family members also involved in such vicious acts. Then, in court record of DV-12-234, DM-12-610, CV-12-1307, and CV-12-10816 each of Barrie and Alain “lied” in criminal perjury and fraud in both testimony and discovery under oath, that Barrie did not have any of David Derringer’s personal property, and Alain Jackson similarly responded under oath in discovery that he also did not have any of David Derringer’s personal property. Barrie testified under oath that she would return the gold wedding ring to David Derringer, which has not been received, and “swore” that she did not have any personal property of David Derringer. At the first of 2014, suddenly, the Jackson legal secretary informed David Derringer that indeed “personal property” of David Derringer was in possession by Alain Jackson, personally delivered to him by Barrie “Crowe”, almost 2 ½ years after the larceny by Barrie Derringer (Crowe),  and that such property was held in the offices on 423 6th St. NW, Albuquerque, New Mexico. Due to the still pending illegal “Order of Protection” of non-jurisdictional DV-12-234, David Derringer still could not possess his firearms and ammunition, and whereas since some firearms and ammunition were “missing” due to the Barrie break-ins and larceny, it was possible that in such “personal property” Barrie had hidden either/or firearms and ammunition. This mandated that David Derringer seek an “inventory” of the claimed “three boxes” of David Derringer personal property before any retrieval could be had, lest the likely sabotage of David Derringer picking up the unidentified “personal property” only to be arrested outside of the Jackson office for possession of firearms and ammunition of the illegal and non-jurisdictional Order of Protection still unlawfully held against David Derringer at that time. Alain Jackson and Barrie Crowe “refused” to give David Derringer an inventory of what was in the “three boxes” of David Derringer personal property. In the interim succeeding days, Alain Jackson moved his office and legal activities to a place unknown, criminally abandoning the David Derringer personal property left with the law firm at 423, 6th St. NW. Albuquerque, New Mexico. In the meantime, before David Derringer could pick up the personal property without any possible planned sabotage by Barrie, David Derringer had to wait until the illegal “Order of Protection” had expired on February 21, 2014. When David Derringer then sought to retrieve his “personal property” Alain Jackson had re-stolen such property and has now concealed such personal property at a place both unknown and undisclosed to David Derringer, preventing retrieval; all acts of Alain Jackson and Barrie Crowe “criminal acts” termed “embezzlement”. In March, 2014 David Derringer sent a “Demand Letter” to both Alain Jackson and Barrie Crowe aka Barrie Derringer aka Barrie Beverley that all David Derringer “personal property” be itemized by inventory sheet and David Derringer would retrieve his personal property formerly stolen and lied about in court that each of Barrie and Alain Jackson did not “possess”. Clearly, they did “possess” illegally and adversely David Derringer’s personal property, although “three boxes” hardly could conceal all of the tens of thousands value of items stolen, with some of size that would not go into “three small boxes” identified by the Jackson secretary, but never seen by David Derringer.

Legally, from the David Derringer perspective, there has been no “abandonment” in “time” by statute of Replevin NMSA 35-11-1 by David Derringer, and thus no legal ability of Barrie or Alain Jackson to keep, auction, destroy, discard or otherwise detain or tamper with the David Derringer “personal property”. It would seem a vicious and illegal game that both Barrie and Alain Jackson keep playing against the legal rights of David Derringer under USC Title 42 Section 1982 “private property rights”, to keep or further damage David Derringer by the larceny and illegal acts ongoing. For a period of 2 ½ years, Barrie has been “relentless” without regard for any of David Derringer’s rights, immunities and privileges under law, and completely without any morality, despite her “Catholic claims of belief in God”, and continues to do extreme damages to David Derringer; her placing in effect with the court damages that keep accruing with or without her direct participation; all of which she knows and will not take any action to stop. This has forced David Derringer to continually litigate to defend himself for 2 ½ years ongoing, and fight both Barrie Crow (Derringer) and her accomplices as well as the corruption of the New Mexico courts. Either Barrie Crowe is having so much “fun” continuing to damage David Derringer or enjoys the constant litigation; in either effect there is no attempt to mitigate or stop damages to David Derringer or any repentance by Barrie.  In any effect, there will be “accountability” for the likely first time in Barrie’s life of her illegal and unwarranted vicious actions against a friend and husband, and the “personal property” will be returned or restitution and damages paid, and in the meantime Barrie can pay some of the value and damages in her time and attorney fees, until redress and justice will be served.
If the personal property illegal held and unlawfully concealed is not returned within 30 days, including the gold wedding ring and all other property taken of money, truck, personal property and other, David Derringer will file new law suits against Barrie Crowe aka Barrie Derringer aka Barrie Beverley, and Alain Jackson, and such litigation will begin anew as they so desire, and simply “moving-on” will not afford escape of redress regardless of  in situ of the parties.
Sincerely,

David Derringer
